W.W. Gay maintains a Drug Free Work Place in accordance with the laws of the State of Florida and the applicable Federal Statutes. We began our program in March of 1989. At that time we had a seventeen percent (17%) failure rate. At present, our program includes pre-employment screening, testing for cause (including post-accident), fitness for duty (for those subject to Federal DOT regulations), random and follow-up testing.

We have a "three strikes you're out" policy. On the first two failures, the employee is suspended without pay for a minimum of one week the first time and a minimum of eight weeks the second time. However, reinstatement after a failure will depend on the availability of work. At the first failure, the employee may return to work after the suspension period so long as they provide a negative test and are enrolled in a treatment program. After a second failure, a treatment program must be successfully completed before the employee can be reinstated. In either case, the employee must pass a drug test before returning to work. If there is a third failure, the employee is fired and his/her records are marked "NOT FOR REHIRE."

Since we adopted our policy in 1989, we have never had an employee fail a third test. We have had some quit rather that take a test and some go into treatment, but we have never had a third failure. Our current failure rate is now less than one half percent (< ½%).
